TRITON GOTO User Agreement

Fuzhou Taijiang District Lingguang Network Technology Studio (hereinafter "Lingguang Network Technology," "we," "us," or "our") hereby reminds users to carefully read and fully understand this TRITON GOTO User Agreement (the "Agreement"). You should carefully read and fully understand all terms of this Agreement, especially those regarding limitation or exclusion of liability, dispute resolution, and governing law.

Clauses that limit or exclude liability are highlighted in bold and require your special attention. Please read carefully and decide whether to accept this Agreement (if you are a minor, you should read this Agreement with your legal guardian). By downloading, installing, accessing, or using the TRITON GOTO software (the "App" or "Software"), you are deemed to have accepted this Agreement and agreed to be bound by all of its terms. If you do not agree, please do not use the App.

To the extent required by applicable laws in your jurisdiction, this Agreement does not limit any mandatory statutory rights you may have as a consumer.

Lingguang Network Technology may revise this Agreement from time to time. The updated terms will be published in the App and will take effect from the date of publication (or any later effective date stated in the notice), subject to applicable law.

1. General Provisions

1.1 The App is software provided by Lingguang Network Technology for connecting astronomical telescopes and related equipment released by Lingguang Network Technology and its affiliates (collectively, the "Astronomy-Related Equipment"). All ownership, operation, and service rights in and to the Software and related services belong to Lingguang Network Technology.

1.2 This Agreement is entered into between you (the "User") and Lingguang Network Technology, its affiliates, and its operating partners (collectively, the "Partners") regarding your use of the App and related services.

1.3 The Software and services include:

• Software services for users of Astronomy-Related Equipment, including device connection and binding, function settings, control features, and other capabilities, as actually provided by the App.
• Updates, upgrades, and other related services for the Software.

1.4 You acknowledge that Lingguang Network Technology only provides the Software and related services. Any costs associated with equipment or access required for use of the Software and services (such as terminal/device costs and internet access fees) shall be borne by you. You also understand that using the App and related services may consume your device resources, bandwidth, and data traffic.

1.5 Minor Users

If you are under 14 years old, you must obtain consent from your legal guardian before using the Software and related services. If you are 14 years old or above but still a minor under applicable law, you should read and accept this Agreement under your guardian's guidance. Guardians may contact us at support@tritongoto.cn at any time to exercise rights such as requesting deletion or correction of a minor's personal information, subject to applicable law.

2. Scope of Software License

2.1 Lingguang Network Technology grants you a personal, non-transferable, non-sublicensable, and non-exclusive license to use the Software.

2.2 You may install, use, display, and run the Software on a single mobile terminal device for non-commercial purposes only. You may not install, use, or run the Software for commercial operations, and you may not copy, alter, modify, run in attachment, or create derivative works from the Software, any data released into terminal memory during operation of the Software, or any interaction data between client and server during operation of the Software. This includes, without limitation, using plugins, cheats, or unauthorized third-party tools/services to access the Software or related systems. Any commercial sale, reproduction, or distribution (such as software pre-installation or bundling) requires prior written authorization from Lingguang Network Technology.

2.3 Without permission from Lingguang Network Technology, you may not install the Software on any terminal device not expressly approved by Lingguang Network Technology.

2.4 You may make one copy of the Software solely for backup purposes for use of the Software and services. The backup copy must include all copyright notices contained in the original Software.

2.5 Except for rights expressly granted under this Agreement, no other rights are granted to you. To exercise any other rights, you must obtain prior written consent from Lingguang Network Technology.

3. Software Updates

3.1 You shall download and install the Software only through channels authorized or designated by Lingguang Network Technology. Please do not download the Software from unknown websites. If you obtain the Software from an unauthorized third party, or install any program using the same name as the Software, Lingguang Network Technology cannot guarantee normal operation of such software and shall not be liable for any resulting losses.

3.2 You must select the software version suitable for your installed terminal device. Otherwise, any software issues, device issues, or damage caused by incompatibility between software version and device model shall be your sole responsibility.

3.3 To improve user experience and service quality, Lingguang Network Technology may provide replacement, modification, or upgraded versions of the Software from time to time. After a new version is released, Lingguang Network Technology does not guarantee continued availability of older versions.

4. Acceptable Use

4.1 Subject to compliance with applicable law and this Agreement, you may use the Software and services in accordance with this Agreement. You shall not:

• Remove any copyright information from the Software or its copies, or modify, remove, or circumvent technical measures used by the Software to protect intellectual property rights.
• Reverse engineer the Software, including disassembly, decompilation, or otherwise attempting to obtain source code.
• Modify or forge instructions or data during software operation to add, remove, or change software functions or operational effects, or operate or disseminate software or methods used for such purposes, whether or not for commercial purposes.
• Use the Software to engage in any conduct that endangers cybersecurity.
• Log in to or use the Software and services via third-party compatible software or systems that are not developed, authorized, or recognized by Lingguang Network Technology, or make, publish, or distribute such tools.
• Without prior written consent from Lingguang Network Technology, use, lease, lend, copy, modify, link, repost, compile, publish, create mirror sites, or otherwise develop derivative products, works, services, plugins, cheats, compatibility tools, or interconnection solutions based on the Software or information therein.
• Use the Software to publish, transmit, disseminate, or store content that violates laws applicable in your jurisdiction.
• Use the Software to publish, transmit, disseminate, or store content that infringes others' intellectual property rights, trade secrets, or other lawful rights.
• Use the Software or other services provided by Lingguang Network Technology in any other unlawful manner, for any unlawful purpose, or in any manner inconsistent with the licensed use under this Agreement.

4.2 You understand and agree that:

• Lingguang Network Technology may determine whether your conduct is suspected of violating the above use rules and may, based on such determination, suspend or terminate your license or take other restrictive measures permitted under this Agreement.
• Lingguang Network Technology may directly remove information posted while using the licensed Software that is suspected to be illegal, infringing, or in breach of this Agreement.
• If your violation of the above use rules causes damage to any third party, you shall bear legal liability in your own name and keep Lingguang Network Technology harmless from resulting losses or increased costs.
• If your violation of law or this Agreement causes Lingguang Network Technology to suffer losses, face third-party claims, or incur administrative penalties, you shall compensate Lingguang Network Technology for resulting losses and/or expenses, including reasonable attorneys' fees and investigation/evidence-collection costs.

5. Service Description

5.1 You understand and agree that the Software may include SDKs/service modules provided by affiliates of Lingguang Network Technology or third parties. For the specific names, purposes, categories of personal information involved, and opt-out methods for third-party services, please refer to the "List of Third-Party SDKs" in the TRITON GOTO Privacy Policy.

5.2 Whether third-party services are pre-integrated into the Software system services or separately activated/subscribed to by you, you understand and agree that Lingguang Network Technology makes no express or implied representation, warranty, or guarantee regarding the legality or validity of third-party service providers or user conduct, or the legality, accuracy, validity, or security of third-party services. Lingguang Network Technology only provides an access interface.

5.3 Lingguang Network Technology does not supervise third-party services, has no control over them, provides no warranty or guarantee of any kind regarding them, and assumes no liability for them.

5.4 Any dispute or controversy between you and a third-party service provider shall be resolved by you and that provider through consultation in accordance with the provider's business procedures and rules. Lingguang Network Technology shall not bear any joint or several liability except as otherwise required by applicable law.

6. Privacy Policy and Personal Information Protection

6.1 Lingguang Network Technology is committed to protecting your personal information in accordance with the TRITON GOTO Privacy Policy.

7. Breach and Remedies

7.1 Lingguang Network Technology has the right to determine whether your conduct complies with this Agreement. If it believes you have violated applicable laws, this Agreement, or related rules, Lingguang Network Technology may, depending on the severity of the violation, take measures including deleting violating information, restricting, suspending, or terminating your use of the Software services, pursuing legal liability, and taking any other measures Lingguang Network Technology deems appropriate. If Lingguang Network Technology suffers any loss as a result (including, without limitation, third-party claims or administrative penalties), you shall remedy such loss within a reasonable period and bear responsibility accordingly.

8. Service Risks and Disclaimer

8.1 To the maximum extent permitted by applicable law, Lingguang Network Technology provides the Software and services based on current technology only, and makes no express or implied warranty of merchantability, fitness for a particular purpose, or non-infringement/non-defect. Lingguang Network Technology does not warrant that operation of the Software services will be uninterrupted or error-free, that all defects will be corrected, or that the Software services will meet all of your requirements.

8.2 When you use the Software or request specific services from Lingguang Network Technology, the Software may invoke third-party systems or software to support your use or access. The results of such use or access are provided by the relevant third party. Lingguang Network Technology does not guarantee the security, accuracy, validity, or other uncertain aspects of outcomes achieved through third-party systems or software support, and assumes no liability for any disputes or damages arising therefrom.

8.3 Lingguang Network Technology specifically reminds you that, for business development needs, it may modify or interrupt all or part of the services at any time after giving reasonable notice to users.

8.4 Except as otherwise expressly required by law, Lingguang Network Technology shall not be liable for any direct or indirect losses arising from service interruption, suspension, termination, or failure to meet your requirements caused by device failure, communication failure, or system instability.

8.5 You shall bear any personal injury, incidental or indirect economic damages, including but not limited to loss of profits, loss of data, business interruption, or other commercial damages or losses, arising from or related to any of the following:

1. your violation of laws, regulations, or this Agreement;
2. damage caused by your failure to operate Astronomy-Related Equipment in accordance with official instructions;
3. your unauthorized modification or cracking of the Software or related device firmware;
4. unauthorized use of your account or modification of your data by a third party;
5. any other cause attributable to you.

8.6 You agree that Lingguang Network Technology may, based on requirements of judicial, regulatory, or supervisory authorities, or for its own business reasons, suspend, interrupt, or terminate all or part of the services provided to you. Lingguang Network Technology shall not be liable for this.

8.7 You understand and agree that Lingguang Network Technology will make commercially reasonable efforts to protect the security of your data storage in the Software and services, but cannot provide an absolute guarantee and is not responsible for data deletion or storage/backup failures in the services.

8.8 Special Risk Notice for Astronomy Equipment Control

The risks described in Sections 8.8.1 to 8.8.15 apply only when you connect, drive, or remotely control astronomy equipment through the Software. If you independently operate third-party software or offline mechanical components, this section shall not serve as a basis for Lingguang Network Technology's liability.

8.8.1 You acknowledge and agree that astronomy equipment such as equatorial mounts, camera focusers, domes, and motorized filter wheels may involve high-speed rotation, strong torque, lasers, intense light, or high temperatures during operation. Improper operation may cause personal injury, equipment damage, or property loss.

8.8.2 Before using the Software to control any astronomy equipment, you shall ensure that:

1. the equipment is stably positioned, with no pedestrians, pets, or obstacles nearby;
2. you have carefully read and complied with the manufacturer's safety manuals and warning labels;
3. travel limits, emergency power cut-off switches, or other necessary mechanical/electrical protections are in place.

8.8.3 Special Warning for Solar Observation

Directly observing the sun, or observing the sun through optical systems such as telescopes, binoculars, or finders, can burn the retina within milliseconds and cause permanent blindness, and may also damage camera sensors.

When using the Software to control a telescope or other optical system for solar observation, you must install full-aperture solar filters compliant with ISO 12312-2 or equivalent certification at the front end of all optical paths (including primary scope, finder scope, and guide scope), and ensure there is no risk of scratches, cracks, or detachment of such filters.

Any personal injury, equipment damage, or property loss caused by improper use of solar filters or improper operation shall be your sole legal and financial responsibility; Lingguang Network Technology shall bear no compensation or joint liability.

8.8.4 When you set or invoke default device parameters via the Software, related speed or limit values are for reference only. You shall verify and configure them according to the specifications of connected equipment. Lingguang Network Technology shall not be liable for compensation for equipment damage, target loss, or data loss caused by improper parameter configuration.

8.8.5 When using the Software in remote or unattended mode, you shall ensure real-time video/sensor monitoring and the ability to immediately cut off power in emergencies. Commands such as "Disconnect," "Stop Tracking," and "Emergency Stop" may not take effect immediately due to network latency. Any resulting loss or liability shall be borne by you.

8.8.6 If, within the Software control chain, you crack third-party devices, flash firmware not provided by Lingguang Network Technology, modify wiring, or operate beyond manufacturer-rated specifications, compatibility and safety of the Software cannot be guaranteed. Lingguang Network Technology assumes no responsibility for related risks or damages.

8.8.7 Warning on Laser Pointer Use

When using the Software to control and enable laser pointers or other Class 3R and above laser products, you must comply with applicable laser safety laws and regulations in your jurisdiction.

It is strictly prohibited to aim laser beams at aircraft, vehicles, crowds, residential areas, or other sensitive targets. Any administrative penalties, civil liability, or criminal liability arising from violation of applicable laws and regulations shall be borne solely by you, and Lingguang Network Technology shall bear no joint liability.

8.8.8 Satellite Tracking and Radio Regulation

When you use the Software to drive antennas or equatorial mounts for precision tracking, telemetry, remote sensing imaging, or radio transmission involving satellites, space stations, or other spacecraft, such activities may involve national security, export controls, and dual-use technology regulation.

Before conducting such activities, you shall obtain any required written approvals from competent authorities under applicable laws and regulations. Any administrative penalties, civil compensation, or criminal liability resulting from unapproved activities shall be borne by you. Lingguang Network Technology may immediately suspend related functions and report to competent authorities upon receiving lawful instructions.

8.8.9 Severe Weather and Lightning Protection

When using the Software to control equipment for outdoor observation during severe weather (including lightning, heavy rain, hail, strong wind, or sandstorms), you must immediately stop observation, cut power, and disassemble or secure equipment.

Outdoor metal supports, tripods, antennas, and control cables should be connected to equipotential grounding systems and equipped with Class C (or higher) surge protection devices; otherwise, lightning or power surges may cause personal injury, circuit burnout, or fire. Any personal injury, equipment damage, or third-party property loss resulting from failure to adopt these protections or timely secure equipment shall be your sole responsibility, and Lingguang Network Technology shall bear no compensation or joint liability.

8.8.10 Power Supply Safety

Where equipment controlled by the Software requires AC mains or battery power, you shall only use power adapters, inverters, and lithium battery packs that meet recognized certifications (such as CE/UL/CCC or equivalent), and ensure overcurrent, overvoltage, undervoltage, and overtemperature protection.

You are prohibited from privately modifying power wiring, paralleling/series-connecting batteries of different brands or capacities, or powering equipment during charging. Lingguang Network Technology shall not be liable for fire, explosion, or economic losses caused by unauthorized rewiring, over-discharge, short circuits, or battery degradation.

8.8.11 Equipment Stability and Mechanical Safety

When using the Software to control large-aperture or high-mass telescope systems, you should use counterweights, ground stakes, or similar measures as appropriate to ensure tripod stability, and add rigid bases on soft soil or slopes. Before use, check mount locking mechanisms, clutches, and brakes to prevent high-speed rotation due to imbalance. You shall bear all legal liability and economic compensation for injuries or property damage caused by equipment falling, tipping, or tube sweep collisions.

8.8.12 Location Information and Privacy Security

The Software may display location information such as latitude/longitude and precise time. Before uploading or publicly sharing such information, you shall de-identify/desensitize it as needed. Lingguang Network Technology shall not be liable for any personal, property, or national security risk arising from your disclosure of observation location, travel tracks, or sensitive celestial coordinates; if Lingguang Network Technology suffers penalties or claims as a result, you agree to indemnify it.

8.8.13 Extreme Environment Restrictions

If you use the Software to control astronomy equipment in environments below -20 C or above 45 C, or at altitudes above 4000 m, equipment component failure may cause device malfunction, personal injury, or economic loss, all of which shall be your sole responsibility. Lingguang Network Technology provides technical support only for software functions used according to instructions in standard environments of -10 C to 40 C and altitude <= 2000 m.

8.8.14 Third-Party Hardware and Combined Modifications

1. Lingguang Network Technology provides after-sales and technical support only for astronomy products (including hardware, supporting firmware, and software) designed/manufactured by itself or sold under official authorization.
2. For uncertified third-party hardware/software (such as telescopes, tripods, guide scopes, cameras, filter wheels, power supplies, firmware plugins, etc.) or user-modified components, Lingguang Network Technology provides no performance guarantee, compatibility guarantee, or repair obligation.
3. If you combine, stack, alter, or flash third-party firmware onto our products together with any third-party products, you shall independently verify mechanical strength, electrical compatibility, and software adaptation, and bear all resulting risks and legal liabilities, including but not limited to:
   • equipment damage (overload, short circuits, mechanical interference, insufficient heat dissipation, etc.);
   • personal injury (counterweight imbalance, high temperature, laser leakage, high-voltage electric shock, etc.);
   • functional failure (protocol conflicts, firmware incompatibility, coordinate-system disorder, etc.);
   • intellectual property risks (claims arising from infringement by third-party firmware/software).
4. Lingguang Network Technology shall not be liable for any failures, errors, data loss, or direct/indirect losses caused by third-party accessories or modified components; in such cases, warranty services, return/exchange services, and technical support will automatically become invalid.

8.8.15 Multi-Software Coordinated Control Risks

If you simultaneously or alternately use the Software and any third-party control software (including ASCOM platform/software, INDI platform/software, and other third-party software compatible with OnStep or LX200 command sets) to send commands to the same astronomy device, the following risks may arise:

1. Command contention: multiple software systems may simultaneously change tracking rate, coordinate solving, or limit parameters, which can disorder driver state and cause sudden stops, reverse collisions, or motor overload.
2. Data overwrite: dates, site settings, pointing models, or PEC tables written by third-party software may be overwritten by this Software in real-time, or vice versa, significantly reducing pointing accuracy.
3. Communication port conflicts: when the same device is connected via USB/serial/Wi-Fi socket/Bluetooth while simultaneously or alternately controlled by this Software and third-party programs, handshake failure, checksum errors, firmware crashes, and similar incidents may occur.

Any personal injury, equipment damage, target loss, data destruction, or direct/indirect economic loss arising from the above coordinated-control risks shall be borne by you, and Lingguang Network Technology shall not be liable for compensation.

8.10 Third-Party Device Compatibility Statement

The Software supports third-party astronomy equipment built through open-source projects such as ONSTEP. Due to differences in vendor firmware versions and protocol implementations, the Software does not guarantee 100% compatibility with all devices or full availability of all functions.

Lingguang Network Technology shall not be liable for any direct or indirect losses caused by third-party device or firmware defects, network conditions, power abnormalities, or similar factors, including equipment loss of control, tracking failure, imaging errors, or data loss.

If your control of third-party devices gives rise to disputes with device manufacturers, third-party platforms, or other rights holders, you shall resolve such disputes with relevant parties yourself and compensate Lingguang Network Technology for losses suffered due to your conduct (if any).

8.11 Remote Services and Unattended Operation

When you enable features such as "Scheduled Imaging" or "Remote Control," you shall ensure that the physical site has power cut-off protection, overload protection, weatherproof facilities, and appropriately skilled on-duty personnel or emergency plans.

Lingguang Network Technology shall not be liable for damage caused by your prolonged absence from site, failure to regularly inspect equipment status, or neglect of weather changes (such as strong wind, rainfall, or sandstorms).

To protect public safety, the Software may push risk alerts when abnormal load, current, voltage, or device posture is detected. However, such alerts are based on currently available technology and are only auxiliary measures; they do not constitute any guarantee by Lingguang Network Technology regarding device safety.

8.12 Shared Risk and User Indemnification

If your use of the Software to control astronomy equipment causes personal injury, property loss, or public safety incidents to any third party, you shall be solely responsible and provide timely compensation. If Lingguang Network Technology suffers administrative penalties, compensation liability, or reputational loss as a result, you agree to bear corresponding indemnification liability and reimburse Lingguang Network Technology for reasonable expenses (including attorneys' fees and evidence-collection costs).

9. Intellectual Property Statement

9.1 Lingguang Network Technology is the intellectual property rights holder of the Software. All intellectual property rights in the Software, including copyrights, trademarks, patents, and trade secrets, as well as all information content related to the Software (including but not limited to text, images, audio, video, charts, interface design, layout framework, related data, and electronic documents), are protected by applicable local laws and regulations and relevant international copyright treaties. Lingguang Network Technology owns the foregoing intellectual property rights. Third-party open-source components are licensed under their respective open-source licenses. For details, please refer to the "Open Source Software Notice" in the App.

9.2 Without prior written consent from Lingguang Network Technology, you may not, for any commercial or non-commercial purpose, implement, use, or transfer the above intellectual property rights, nor authorize any third party to do so. Lingguang Network Technology reserves the right to pursue legal liability for such acts.

10. Amendments to This Agreement

10.1 Lingguang Network Technology may amend this Agreement when necessary. Once terms are changed, the revised terms will be published on relevant pages. If you do not agree to the changes, you should stop using the relevant services. Your continued use of the services constitutes acceptance of the amended terms, subject to applicable law.

10.2 Lingguang Network Technology may adjust or modify paid services, charging standards, charging methods, service fees, and service terms as needed. Lingguang Network Technology may begin charging certain users for some services now or in the future. If you refuse to pay such fees, you may not continue to use the relevant services after charging begins.

11. Governing Law and Dispute Resolution

11.1 The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the jurisdiction where Lingguang Network Technology is registered, unless otherwise required by mandatory laws applicable in your place of residence.

11.2 The place of execution of this Agreement is Taijiang District, Fuzhou, Fujian, China.

11.3 Any dispute arising from or in connection with this Agreement shall first be resolved through friendly consultation. If consultation fails, either party may submit the dispute to the court with competent jurisdiction at the place of execution of this Agreement, unless otherwise required by applicable consumer protection laws.

12. Miscellaneous

12.1 Lingguang Network Technology may notify users of amendments to service terms, service changes, and/or other important matters by email, SMS, webpage announcement, or any other method deemed appropriate by Lingguang Network Technology.

12.2 The update date of this Agreement is May 1, 2026.

12.3 The headings of all clauses in this Agreement are provided for convenience only and have no substantive meaning; they shall not be used as a basis for interpretation of this Agreement.

12.4 If any provision of this Agreement is held partially invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
